Welcome to PCXCEL! These Terms and Conditions govern your use of our website (www.pcxcel.co.za) and any products or services offered by us, including website design and development, hosting, email services, PC repairs, social media marketing, and related offerings.
By using our website or contracting with us, you agree to be bound by these Terms. Please read them carefully.
1. Acceptance of Terms
By accessing or using any part of our website or services, you agree to comply with and be legally bound by these Terms & Conditions, as well as our Privacy Policy. If you do not agree to all terms, you may not access the website or use any services.
2. Services Provided
PCXCEL offers the following core services:
Website design and development
Web hosting and domain registration
Professional business email setup
Social media marketing and branding
PC and laptop repairs (on a selective basis)
All services are subject to individual service agreements that define project scope, pricing, timelines, and deliverables. Where applicable, these agreements override or supplement the general terms outlined here.
3. Client Responsibilities
Clients agree to:
Provide accurate, complete, and timely information necessary for service delivery
Abide by applicable local and international laws (including content, copyright, and online behavior)
Refrain from using our services for any unlawful, fraudulent, or harmful activities
Keep login credentials, passwords, and access details confidential
Promptly communicate any service or technical issues to PCXCEL
PCXCEL is not liable for project delays or performance issues caused by the client’s failure to meet their responsibilities.
4. Intellectual Property Rights
All content, source code, graphics, logos, images, and branding created by PCXCEL remain the property of PCXCEL until full payment has been received. Upon full payment, the client will receive a license or ownership transfer as defined in the service agreement.
You may not:
Copy, modify, distribute, or reproduce any content without permission
Use our branding, logos, or code for any purpose without written consent
5. Payment Terms
Payments must be made as agreed upon in your service agreement or invoice.
Accepted payment methods include EFT (Electronic Funds Transfer) and other methods such as Online Payments via PayFast.
Hosting and maintenance fees (e.g., R345/month) are billed monthly in advance. Non-payment may result in service suspension.
PCXCEL reserves the right to withhold delivery or suspend services if invoices are overdue.
6. Refund & Cancellation Policy
Refunds are processed in accordance with the following:
Deposits for custom website or branding services are non-refundable once development has begun.
Monthly hosting or maintenance fees are non-refundable for the billing period once paid.
Full or partial refunds may be issued at the discretion of PCXCEL if services are not delivered as agreed in writing.
Clients may cancel ongoing services (e.g., hosting, maintenance) from user dashboards.
7. Design Revisions & Change Requests
Upon delivery of the initial website design, the client is entitled to:
1 major revision (e.g., layout changes, structure alterations, feature redesigns)
5 minor revisions (e.g., text changes, image updates, small style tweaks)
Further revisions will be billed at an hourly rate as specified in your service agreement. All revision requests must be submitted within 7 business days of delivery to avoid delays.
8. Service Availability & Performance
We aim to provide reliable and uninterrupted access to our services, but cannot guarantee 100% uptime or error-free operation. Service interruptions may occur due to hosting issues, internet disruptions, third-party service outages, or routine maintenance.
9. Limitation of Liability
To the maximum extent permitted by law, PCXCEL shall not be liable for:
Indirect, incidental, or consequential damages
Loss of data, business, or revenue resulting from service use or website downtime
Any claims exceeding the amount paid for the service in question
10. Warranties and Disclaimers
PCXCEL provides services on an “as is” and “as available” basis. We make no warranties, express or implied, regarding:
The suitability of services for your specific business needs
Continuous, error-free, or virus-free operation
The exact results expected from marketing, SEO, or design services
11. Privacy and Data Protection
Your use of our website and services is also subject to our Privacy Policy, which complies with the Protection of Personal Information Act (POPIA) and other applicable laws. You are encouraged to review it regularly.
12. External Links and Third-Party Services
Our website may contain links to third-party platforms (e.g., social media, plugins, payment providers). We are not responsible for the content, data practices, or availability of these external sites. Please review their individual terms and privacy policies before use.
13. Termination of Services
PCXCEL may suspend or terminate services without notice if:
You breach any of these terms
You engage in unlawful or harmful behavior
Payment obligations are not met
You may also terminate services with written notice in line with your service agreement. Termination does not relieve you of any due fees or outstanding obligations.
14. Governing Law & Jurisdiction
These Terms are governed by the laws of South Africa. Any disputes arising from or related to our services shall be subject to the exclusive jurisdiction of the Free State High Court or other competent South African courts.
15. Updates to These Terms
We reserve the right to update or modify these Terms & Conditions at any time. Any changes will be posted on this page with the updated effective date. Continued use of our services constitutes acceptance of the revised terms.
